If you thought the Petition whitewash with the help of your friends in Sussex Police was the end of your worries, you may want to consider turning states evidence!

 

You no doubt left Wealden with an enhanced pension. Proceeds of crime! We wonder! Just how good was your pension package? it is alleged that you demanded £250,000, presumably for your part in the Petition cover-up, where the bubble as to Council's Nazi like thuggery was about to be exposed - and it seems that you were the fall guy for the planning Gestapo that you had allowed to continue running riot.

 

Two Hundred and Fifty Thousand Pounds of tax payers money seems like an awful lot by way of a golden handshake - and to our mind a misuse of public monies. We wonder if there was any other kind of funny handshake involved. Please confirm or deny the sums involved and why you took so much?

 

We wonder how many more officers involved in the Petition scandal, or in case brought to light by that scandal, also got an enhanced pension. We understand that David Phillips also made off with a nice little package.

 

Does this generosity extend to the early retirement packages of the Sussex Police officers who failed to investigate the petitioner's complaints?

 

Bulldozing an animal sanctuary was bound to get your Council in trouble - what were you thinking of?

 

Allowing her landlord to set fires outside her house and remove her roof tiles was also a serious abandonment of your duty to protect the public. Was the landlord a friend of yours, or what was your reasoning in failing to act to protect this member of the public?

 

Nursing the lie as to the historic generating station at Herstmonceux was also a serious error of judgment. Again, what were you thinking of?

PLANNING CRIME - MISUSE OF AUTHORITY

 

I have raised this subject previously thinking that you would have taken steps to prevent such occurrences. However, new cases have been reported, where the same departments complained of previously appear to be responsible.

I have consulted generally with the Planning Inspectorate and it would appear that the cases I cite fall to be considered under the Town & Country Planning Act 1990 as amended by S.194. Therein it is stated that it is a criminal offence to knowingly or recklessly withhold information which may prove or disprove the facts in relation to Certificate of Lawful or Existing Uses. Other issues fall to be considered under the Magistrates Court Act, Solicitors Act and the Supreme Court Rules. All of which offences appear to fall into the category of criminal law.

Two case involve the use of identical photographs, claiming different date attribution. One case is where a photograph on file which proved an appellant’s case was withheld. One case involves an enforcement notice with a later plan attached to describe a larger area. One case involves the withholding of later enforcement notices which show a greater area than admitted on the first. Other cases of misdirection, especially at Committee level, are known to me. Please see Appendix.

It would appear from the above that the Wealden District Council regularly and as a matter regime, withhold, manipulate and in some cases fabricate evidence to achieve their preferred planning viewpoint. Some may say the officers concerned are over zealous, simply crafting their case, but I say that however enthusiastic these officers might be to prevent legitimate development – such practices are illegal and the frequency of events appears more than a claim of administrative error might support.

Could I please ask you to investigate and make a report to the full Council, with a view to reporting offenders to the relevant authorities.

SUSPECTED CASES OF PLANNING CRIME
WEALDEN DISTRICT COUNCIL

 

 

1. Wealden Vs Charnley – Magistrates Court Uckfield

Wealden claimed administrative error in the Magistrates Court in respect of photographs with incorrect date attribute – to be investigated.


2. Wealden Vs Hudson - CLEUD Inquiry APP/X/96/C1435/002614 

The Council withheld colour aerial photograph on case file to allow Council to argue a use of the land did not exist at that time. The photograph showed that the use had begun at the date of taking – under investigation.


3. Wealden Vs Kruschandl - High Court & APP/C1435/A/96/265962

The Council signed a copyright agreement - subsequent use of copyright photographs said to have been returned, admits breach of copyright and agreement + incorrect date attribute - to be investigated.


4. Wealden Vs Kruschandl – CLEUD Inquiry APP/X/98/C1435/002904

The Council claimed an enforcement plan covered a whole site, withholding a later enforcement plan for an unrelated use, which showed more building area, the extra area identified thereon being a workshop, the subject of the application – to be investigated


5. Wealden Vs Lomax - CLEUD Application

The Council appended a modern plan including additional area of cover to an early enforcement notice to be able to refuse the issue of a CLEUD + additional anomalies as to procedural requirements – to be investigated.


6. Wealden Vs De Rivaz - Crown Court 

The Council erased levels from a contour map to allow them to argue that water flowed uphill. Council proceeded without statutory authority claiming a test case - later informing the Court it was not a test case – to be investigated.

I am seeking to ascertain possible motives for impropriety where possible discrimination applies. In respect of my studies could you please answer the following questions:-

1. Apart from promotional prospects and/or job security, are there direct cash incentives or bonuses to officers in the planning, legal and enforcement departments to bring cases against members of the public? Additionally, are any of your staff self employed, paid by the hour or otherwise subcontracted?

2. Most Council’s insist that members of their staff dealing with the public should sign a Confidentiality Agreement. Others are specifically required to do so in respect of the Data Protection Acts. Could you please say if there are any exceptions and confirm whether or not your Council take such precautionary measures?

3. Lastly, could you please confirm that your legal staff, enforcement officers and planning personnel are supplied with a contract of employment? Assuming that the answer is in the affirmative, could you please say where any such documents may be accessed and or who would require special authority to view?

PRIVATE NUMBER PLATE - This car and the cherished plate were paid for by the hard earned money of Council Tax payers, extorted from you as Council Taxes that may have been considerably less if we did not have to pay officers of the Wealden District Council so much to keep them in a life of luxury.

 

Typically, Wealden's officers retire on an enhanced pension package for their part in what some people might describe as eugenics agendas, somewhat lesser on the scale of human atrocities than the Holocaust, but nevertheless, a walk on the wrong side of reasonableness.

 

The man in the photograph is Derek Holness. He drives a BMW Z3 soft top sports car. We would draw your attention to the Petition from 1997 and the fact that a letter was read out to a Full Council meeting purporting to be from the Sussex Police, but that in fact there was no investigation of the 12 complainants and there is no crime number. Hence, the CPS could not have been involved to look at nothing, let alone say that there was insufficient evidence to mount a prosecution.

 

This is probably one of the most disturbing stories that we have covered, because Sussex Police are implicated in a cover up, where they are alleged to have supplied blank headed paper for this Council to write what they wanted their members and the press to hear. As the then Chief Executive, Mr Holness cannot deny that he knew what was going on.

 

Sheelagh Douglas and Lesley Barakchizaden followed Derek Holness after his rapid departure from office at that time. It is most interesting to note that Sheelagh and Lesley also parted company with Wealden after learning of the cover up and the potential implications of continuing to work for what is alleged to have been a corrupt council. The burning question is will there ever be an investigation and a trial of the officers concerned in this cover up.

POTTY TRAINING - Using a potty may be a new skill for your planning team to learn. It's best to take it slowly and go at your candidates pace, about the same pace as a child should do the trick. Being patient with them will help them get it right, even if they sometimes feel frustrated. They should be taught that every person is entitled to a toilet no matter how much their team are out to get any challenging member of the public - and yes we know how irritating it is to be caught out - and yes of course that makes you hate that member of the public more - so that you try another dirty trick. So, if you are going to plan a vendetta, be sure that you don't get caught with your trousers down. Bury your target good and proper - or he or she may come back to haunt you with the inconvenient truth and reveal what you did and why you did it.

 

This is how to train a child: Children are able to control their bladder and bowels when they're physically ready and when they want to be dry and clean. If that is the case do not move to the Wealden District, and never challenge a Councillor or officer of this council.

 

Every child is different, so it's best not to compare your child with others. Bear in mind that most children can control their bowels before their bladder.

* By age one, most babies have stopped doing poos at night.
* By age two, some children will be dry during the day, but this is still quite early.
* By age three, 9 out of 10 children are dry most days – even then, all children have the odd accident, especially when they're excited, upset or absorbed in something else.
* By age four, most children are reliably dry during the day.

It usually takes a little longer for children to learn to stay dry throughout the night. Although most learn this between the ages of three and five, up to one in five children aged five sometimes wet the bed.

you can't force your child to use a potty. If they're not ready, you won't be able to make them use it. In time, they will want to use one – most children won't want to go to school in nappies any more than you would want them to.

In the meantime, the best thing you can do is to encourage the behaviour you want - such as not discriminating against anyone. Be fair and reasonable and try not to violate Articles 6 and 14 - unless it is the only way. Of course, find a judge who does not really know what they are doing. Believe us there are quite a few out there.

Most parents start thinking about potty training when their child is between two and two-and-a-half, but there's no perfect time. Some people find it easier to start in the summer, when there are fewer clothes to take off and washed clothes dry more quickly.

Try potty training when there are no great disruptions or changes to your child's or your family's routine. It's important to stay consistent, so you don’t confuse your child or if you are instructing your planning officers, don't tell them to get the "Bastard" at all costs, or they are bound to cause your council trouble for the future when Dame Butler-Sloss explains that the toilets can go back, after they have been removed to make you council feel it was worth squandering all of that ratepayers money

HOUSE TRAINING COUNCILS - Making councils obey the law of the land is incredibly difficult where institutionalized discrimination is rife and there are too many vested interests for them to be able to do the right thing. We need then to look at how we train animals not to foul our houses, for guidance on how to treat officers and members that are well versed in controlling development to suit their pockets, rather than the pocket of all those young families that cannot afford to live because of council's like Wealden.
